Abstract
本研究旨在探討2023年《刑事訴訟法》修正後,鑑定新制對我國醫療鑑定領域之衝擊與影響,並提出具體制度改革建議。過往醫療鑑定制度因匿名、程序不透明及鑑定人不出庭等問題,常導致當事人難以質疑鑑定內容,影響審判公正性。本次修法雖旨在強化對質詰問權與防禦權保障,要求鑑定人具名並出庭,然而實務上卻引發醫師鑑定意願大幅下降、鑑定案件停擺之困境,突顯法律制度未能兼顧醫療專業特性與實務現況所導致的落差。本研究採用文獻分析、比較分析與專家訪談法,首先回顧我國醫療鑑定制度沿革與既有缺失,接著深入分析《刑事訴訟法》新制內容及其對醫療鑑定之影響。研究亦借鏡日本與德國的醫療鑑定經驗,探討其制度設計與運作模式對我國的啟示。此外,透過訪談檢察官、醫師及律師等實務工作者,本研究呈現新制實施後,醫療鑑定在實務操作中所面臨的挑戰,包括鑑定人短缺、對質詰問流於形式、以及機關鑑定例外規定之疑慮及實務需求。研究發現,新制雖有助於提升程序透明度與證據可信度,但在實務面臨醫師參與意願低落、醫法專業隔閡未有效解決等問題,導致修法目的難以完全實現。本研究建議,未來制度改革應從多面向著手:1.強化司法專業支援:借鏡日本「專門委員制度」、建立專家參審制度及提升司法人員對醫療專業之理解等。2.改革鑑定模式,促進專業對話:推動多元鑑定模式,如參考日本圓桌鑑定制度或複數鑑定人制度。3.優化訴訟程序:如調整鑑定人法庭詰問方式及參考日本計畫審理制度等。4.參考德國鑑調會建立訴訟外鑑定制度化,完善我國醫預法,實現訴訟外前端分流。5.降低鑑定人負擔、調整報酬,以提升參與意願:提供合理報酬或配套保障,如身份隱匿與人身安全防護等。6.建立多元鑑定機構:打破醫審會壟斷局面,促進民間醫療鑑定機構發展。7.政府資源投入與科際整合:從根本上解決醫法隔閡,建立醫法互信合作的制度文化。本研究期望能為我國醫療鑑定制度之完善提供具體且可行之參考依據,以在程序正義與專業參與之間取得平衡。
