Abstract
近年來,3D列印技術在醫療領域中的應用已越來越多,作為3D列印技術發展和醫療應用的重要國家,加上COVID-19 大流行期間醫療器材短缺之因素,美國已經開始在醫療場域中採用3D列印技術來生產醫材,達到即時性、個人化、成本低的優點。

為了理解3D列印醫療器材在上市前、後所需遵循的法規與產品責任跟一般製程之傳統醫材有何不同,本文首先整理了美國與台灣醫療器材上市法規,並蒐集FDA與TFDA所發布的3D列印醫療器材相關指引。而後,根據美國「於定點照護場合中 3D 列印醫療器材」(3D Printing Medical Devices at the Point of Care) 討論文件中所描述的三種使用及製造情境,分析若有瑕疵之3D 列印醫材造成病人受傷,承擔病人損害賠償之主體與產品責任歸責原則。

醫療器材產業是台灣備受重視的潛力領域之一,而 3D 列印技術正影響著全球醫療保健事業的發展。本文藉由文獻分析法,著重於美國及台灣現階段對於3D列印醫療器材之監管策略及產品責任問題之釐清,希望能為相關領域人士產生幫助。
